Welcome to Hynts. These Terms of Service ("Terms") govern your access to and use of the Hynts mobile application, website, and related services (collectively, the "Service") operated by Wholesome Studio LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

You may use certain features of the Service without creating an account (anonymous play). To access additional features such as creating private games, viewing game history, and appearing on leaderboards, you must register for an account.

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be involved in fraudulent or harmful activity.

3. Game Rules & Fair Play

Hynts is designed to be a fun, fair, and competitive experience for all players. You agree to:

• Play honestly and not use any automated tools, bots, scripts, or exploits to gain an unfair advantage
• Not reverse-engineer, decompile, or attempt to extract the source code of the Service
• Not interfere with or disrupt the Service, servers, or networks connected to the Service
• Not attempt to access game answers, hint data, or word banks through unauthorized means
• Not harass, abuse, or threaten other players through display names or any communication features
• Not create multiple accounts to manipulate leaderboards or matchmaking

We reserve the right to disqualify scores, remove leaderboard entries, and suspend or ban accounts that we determine, in our sole discretion, have violated fair play standards.

4. User Content & Display Names

You are responsible for the display name you choose and any content you submit through the Service. Display names must not contain offensive, discriminatory, sexually explicit, or otherwise inappropriate content. We reserve the right to change or remove any display name that violates these standards without prior notice.

5. Intellectual Property

The Service and its original content (including but not limited to game design, visual design, code, text, graphics, logos, icons, sounds, and the AI-generated hint system) are owned by Wholesome Studio LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, or distribute any part of the Service
• Use the Service or its content for commercial purposes without written permission
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Hynts name, logo, or branding without written authorization

6. Subscriptions & Payments

Hynts Pro

Hynts offers an optional premium subscription ("Hynts Pro") that provides additional features and benefits. Hynts Pro includes a free trial period as described at the time of purchase.

Billing

Subscriptions are billed on a recurring basis (monthly or annually) through the platform on which you subscribed (Stripe for web, Apple App Store for iOS, Google Play Store for Android). By subscribing, you authorize recurring charges until you cancel.

Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will continue to have access to Pro features until then. Refunds are handled in accordance with the policies of the applicable payment platform:

• Web (Stripe) — Contact us at shailesh@wholesome.studio for refund requests
• iOS — Refunds are managed through Apple. Request a refund from Apple
• Android — Refunds are managed through Google Play. Request a refund from Google

Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle after the notice period.

7. AI-Generated Content

Hynts uses AI to generate hints, evaluate guesses, and score closeness. AI-generated content is created dynamically and may occasionally contain inaccuracies or unexpected results. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. We continuously monitor and improve our content generation systems.

8. Availability & Modifications

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes changes to game modes, features, scoring systems, and gameplay mechanics. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHOLESOME.STUDIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Wholesome Studio LLC and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Effective" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
